The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, "Terms of Use"), govern your access to and use of The Colony App, opencolony.com, opencolony.net, opencolony.org, opencolony.agency, ochq.co, including any content, functionality, and services offered on or through The Colony App, opencolony.com, opencolony.net, opencolony.org, opencolony.agency, ochq.co, (the “Websites and App"), whether as a guest or a registered user.
Please read the Terms of Use carefully before you start to use the Website. By using our Websites and Colony App or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, found at Privacy Policy incorporated herein by reference. If you do not want to agree to these Terms of Use or the Privacy Policy, you must not access or use the Website.
Our Websites and Colony App are offered and available to users who are 18 years of age or older. By using Websites and Colony App, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use Websites and Colony App.
We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Websites and Colony App thereafter. However, any changes to the dispute resolution provisions set out in Governing Law and Arbitration will not apply to any disputes for which the parties have actual notice on or before the date the change is posted on the Websites and Colony App.

We reserve the right to withdraw or amend Websites and Colony App, and any service or material we provide on the Websites and Colony App, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Websites and Colony App is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Websites and Colony App, or the entire Websites and Colony App, to users, including registered users.

You agree that all information you provide to register with this Websites and Colony App or otherwise, including, but not limited to, through the use of any interactive features on the Website, is governed by our Privacy Policy and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

When you purchase a program, product, course, or service, including, but not limited to, Career Design, Bootcamps, Events, Coaching (each, a “Digital Product”), you agree to be bound to these Terms of Use. You are legally bound to these Terms of Use whether you have read them or not. If you do not agree with these Terms of Use, please email us at contact@opencolony.com and we will make all reasonable efforts to remove your name, email, and access to Course and the Websites and Colony App.
Limited License. Subject to and in accordance with these Terms and other guidelines or instructions we include in the Digital Product, we grant you a limited, non-transferable, non-sublicensable, non-exclusive, revocable license (“License”) to make individual use of the Digital Product, including any courses purchased by you. Your purchase of any Digital Product only entitles you to view that Digital Product in accordance with the foregoing License, and is not a purchase of the software or content constituting or included in the Digital Product. More specifically, unless explicitly authorized in these Terms or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Digital Product(s). You may, however, from time to time, download and/or print one copy of the individual pages of the Digital Product for your individual use, provided that you keep intact all copyright and other proprietary notices.
The License is for individual use. You may not assign or transfer any of your rights or obligations under this Section or these Terms of Use to any person or entity and any attempt to do so is void.
We reserve the right to terminate your access to the Digital Product at any time if we find that you have violated these Terms. We will make every attempt to notify you of any violation of these Terms and give you an opportunity to remedy the violation. However, if you fail to remedy the violation or continue to Violate the Terms, we will terminate your access to the Digital Product with no refund of fees.
Fees. Fees for Digital Products are set forth on Websites and Colony App or via sales sheets. We reserve the right to change Digital Product Fees at any time.
Refunds. We want you to be satisfied with your purchase but we also want you to give your best effort to utilize and apply all of the strategies in, as applicable, the Digital Product. All Sales are final. If you have a scheduling conflict or personal emergency that you believe warrants a refund, please reach out to us at contact@opencolony.com
In the event that you decide your purchase was not the right decision for you or your business, within 2 days of purchase, contact us at contact@opencolony.com and let us know you’d like a refund by the 2nd day at 11:59 PM PST. All refunds are discretionary as determined by Company.
We will NOT provide refunds more than 2 days following the date of purchase. After that, all payments are non-refundable and you are responsible for full payment of the fees for the program regardless if you complete the program.
Please note: If you purchase a Digital Product based on a payment plan and do not request a refund within 2 days of purchase, you will be responsible for remaining payments regardless of whether you utilize the Digital Product.
Recurring Payments. If you have signed up for a payment plan, you hereby authorize our continued access to your financial information stored by our third party financial processing company referenced in this Agreement until your payment plan is complete, as set forth in your acceptance of the purchase terms upon checkout.
Late Payments. If payments are not made on time, you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.
Chargebacks. You agree to make every attempt to request a refund prior to attempting a chargeback with your financial institution. In the event of a chargeback attempt, you expressly agree to forfeit any and all of our bonuses, affiliate bonuses or other materials afforded to you in exchange for your original purchase of our Digital Product. We reserve the right to present proof of your access and these Terms to the financial institution investigating the dispute.
You have the unilateral right to terminate your use and access to any of our Digital Product(s). Please send an email to contact@opencolony.com to initiate this process. Termination will not excuse you of further payment. Upon confirmation of your termination, any and all outstanding balances will become immediately due and payable. Any existing balance that remains after 30 days from the date of termination will be sent to a collections agency, and you agree to be responsible for any additional charges, fees or costs associated with such a collection effort, including but not limited to reasonable attorney’s fees and court costs.
The Websites and Colony App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms of Use permit you to use the Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:
Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

The Company name, the terms Career Design, The Colony, Open Colony, Search Bootcamp, Career Design Bootcamp, the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Websites and Colony App are the trademarks of their respective owners.
You may use the Websites and Colony App only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Websites and Colony App:
In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).

There are no public user contribution sections on our Websites. The Colony App is by invitation only and membership is completely anonymous unless you agree to introductions to other Colony members. Postings of insights, careers, and other user contributions are curated and anonymous unless you give content to share your name. The Colony experience (collectively, "Interactive Services") that allow us to post, submit, publish, display, or transmit to other users or other persons (hereinafter, "post") content or materials (collectively, "User Contributions") on or through the Colony App or anonymously as “Colony Insights” on our websites.
All User Contributions must comply with the Content Standards set out in these Terms of Use.
Any User Contribution we post to the Colony App or Websites with your consent will be considered confidential and proprietary. By providing any User Contributions to us, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose.
You represent and warrant that:
You own or control all rights in and to the User Contributions and have the right to grant the license granted above to us and [our affiliates and service providers, and each of their and our respective licensees, successors, and assigns.

In the case that you agree to introductions inside The Colony App, User Contributions and conversations between two Colony members and Open Colony are private.

Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms of Use, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Website or the public, or could create liability for the Company.
To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the Content Standards set out in these Terms of Use.
Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Website.

Accordingly, we assume no liability for any action or inaction regarding transmissions, communications, or content provided by any user to another user or third party without our permission. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this section.
These content standards apply to any and all User Contributions and use of Interactive Services. User Contributions must in their entirety comply with all applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, User Contributions must not:
